Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website at thatonemediacompany.com and the client account, bookings, and media services offered by ThatOneMedia (“we,” “us,” or “our”), based in Wilmington, North Carolina. By creating an account or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to create an account or book services. By using the Site you confirm that you meet these requirements.
2. Your account
You are responsible for activity under your account and for keeping your sign-in method secure. Sign-in uses Google or a one-time email link; do not share access. Tell us promptly if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
3. Bookings and shoots
Requests submitted through the Site are requests, not confirmed bookings, until we accept them. Scope, scheduling, deliverables, pricing, deposits, travel, and cancellation or rescheduling terms are agreed between you and us for each engagement. You agree to provide safe and lawful access to any property to be photographed and to have the authority to authorize the shoot.
4. Media, ownership, and license
Unless your written engagement says otherwise:
- We retain ownership and copyright of all photos, video, and other media we create.
- On full payment, we grant you a non-exclusive license to use the delivered media to market the specific property or brand for which it was created, including on listing services and social media.
- The license does not permit resale, sublicensing, or transfer of the raw or edited files to third parties (other than your listing service or co-marketing partners for that property), and does not transfer copyright.
- We may use the media in our portfolio, website, and marketing unless we agree otherwise in writing.
5. Acceptable use
You agree not to:
- Use the Site or media for any unlawful purpose.
- Attempt to access accounts, data, or systems that are not yours.
- Interfere with, disrupt, or probe the Site, or circumvent its security.
- Misrepresent your identity or your authority to book a shoot or use media.
6. Referral program
If we offer referral rewards, rewards are subject to the terms shown in your account and may be changed or ended at any time. Rewards have no cash value and may not be obtained through fraud or abuse.
7. Intellectual property
The Site, including its design, text, logos, and code, is owned by us and protected by intellectual-property laws. You may not copy, reproduce, or create derivative works from the Site without our permission.
8. Third-party services
We rely on third-party providers (including Supabase, Vercel, Google, and Resend) to operate the Site. Your use may also be subject to their terms, and we are not responsible for third-party services.
9. Disclaimers
The Site is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the fullest extent permitted by law, ThatOneMedia will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site or services. Our total liability for any claim relating to the Site or a given engagement will not exceed the amount you paid us for that engagement.
11. Indemnification
You agree to indemnify and hold harmless ThatOneMedia from claims, losses, and expenses arising from your misuse of the Site or media, your breach of these Terms, or your violation of any law or third-party right (including property-access and likeness rights).
12. Termination
You may stop using the Site and ask us to close your account at any time. We may suspend or terminate access if you breach these Terms or if necessary to protect the Site or other users. Sections that by their nature should survive termination will survive.
13. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in North Carolina.
14. Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date above, and your continued use of the Site after changes take effect means you accept the updated Terms.
